Professional Experience
Max’s practice focuses on real estate matters and related civil litigation. He assists clients with the preparation and review of real estate documents, real estate transactions, landlord-tenant matters, mortgage and foreclosure issues, property disputes, and other matters affecting the ownership, use, and transfer of real property. Whether a matter involves preparing documents to accomplish a client’s objectives or resolving a dispute,
Max approaches each matter with careful attention to the underlying facts, applicable law, and practical considerations affecting the client.
Max also brings hands-on litigation experience to his real estate practice. He has represented clients in property disputes and has experience evaluating and developing cases, drafting pleadings and motions, conducting discovery and depositions, working with expert witnesses, preparing witnesses, and preparing matters for hearing and trial.
His property litigation experience includes New Mexico land grant litigation and participation in a multi-day trial involving disputed property rights.
Before joining Whittaker Law, LLC, Max served as a Legal Fellow with the New Mexico Department of Justice, where he worked on civil and regulatory matters involving consumer protection, utilities, privacy, regulatory enforcement, and antitrust law. His work included legal analysis and drafting, discovery, case development, and preparation for hearings and other proceedings.
Max also worked with the Navajo Nation Department of Justice, addressing legal issues involving tribal sovereignty, civil jurisdiction, environmental law, and business entities. These experiences strengthened his ability to analyze complex legal and factual issues and develop practical solutions for clients.
At Whittaker Law, Max applies this combination of transactional, property, and litigation experience to help clients protect their real estate interests, prepare and review important legal documents, resolve landlord-tenant and property disputes, and navigate real estate matters before they develop into more costly problems.
